Rental Terms and Conditions

Please Read These General Conditions of Rental and Sale ("Conditions") Carefully Before Entering into the Rental Agreement

1. Definition and Object of the Contract

1.1 – This contract governs the booking, rental, and sale of movable goods, specifically clothing (hereinafter referred to as "Products"), between LE PEG DI PEGORARI AMBRA (Tax Code 02602710069 "LEPEG"), with its registered office at Corso Trento 15, 15033 Casale Monferrato (AL), Italy, and the consumer ("Customer").

1.2 – The contract is executed directly through LEPEG's acceptance of a rental proposal submitted by the Customer via the internet, following the invitation to offer content on the website WWW.LEPEGCOUTURELAB.COM ("the Site"), and/or through other remote rental systems operated by LE PEG, according to the methods described in Article 4.

1.3 – To submit the rental proposal mentioned above, the Customer must either register and create a LEPEG account through the designated action on the Site or place the order without registration. During registration, the Customer must provide their name, surname, and e-mail address, and create an alphanumeric password. LEPEG will then create and activate the account following a successful verification procedure, confirmed by a specific e-mail sent to the address provided by the Customer. The Customer agrees to provide valid and current information wherever requested (during registration, when placing a rental order, etc.).

1.4 – These General Conditions of rental/booking and particularly the information referred to in Article 52 of the Consumer Code, as available on the Site, will remain valid and effective until they are amended and/or supplemented by LEPEG. Any modifications and/or additions to the General Conditions will become effective from the date they are publicly communicated and will apply to rentals initiated from that date. The most recent version of the General Conditions is available on the Site.

2. The Products

2.1 – The products that are the subject of the contract between LEPEG and the Customer are of high quality. These products are authentic, purchased directly from fashion houses and/or distributors by LEPEG.

2.2 – The essential characteristics of the products are presented on the Site, within each product description page. However, due to the differences in Internet browsers and monitors, the images and colors of the Products may not accurately reflect their true appearance.

3. Rental Formulas

3.1 – Rental conditions include a standard rental period of four days.

3.2 – The rental period for the Product begins on the day the goods are received by the Customer at the delivery location specified by them.

3.3 – The Customer may request to extend the rental by directly contacting LEPEG at info@lepegcouturelab.com. The extension is subject to availability and not having conflicting orders for the Product for the requested extension period. If the Product is not available, the Customer is obligated to return it by the originally agreed deadline. If the dress is not returned on time, the Customer will incur a daily fee of 25% of the rental price.

4. Rental Rates

4.1 – The rental rates for the Products listed on the Site, as well as the list prices mentioned in the specific section, include VAT and any other applicable taxes.

4.2 – The rental rates cover the costs of the laundry service each dress undergoes after being returned by the Customer.

4.3 – The rates include a standard guarantee covering the risk of minor damages as per Article 13.1 of these Conditions.

4.4 – LEPEG reserves the right to modify the rates at any time. Such changes will be applicable to rentals made after the date of the rate change.

5. Rental and Payment Methods

5.1 – Upon submitting a rental proposal via the Site, the Customer will receive an email from LEPEG summarizing these Conditions and the characteristics of the selected Product. This email also serves as LEPEG's confirmation of the acceptance of the rental proposal submitted by the Customer. If the email is found in the Junk Mail box, the Customer is expected to approve the sender to avoid issues with future communications.

5.2 – LEPEG reserves the right to decline rental or trial orders from individuals who cannot be contacted through the provided contact methods (telephone, email) or orders that do not align with the company's commercial policies, such as orders suspected of fraudulent or illegal activities. In such cases, LEPEG will inform the user about the non-acceptance of the order.

5.3 – If the delivery of an order is delayed or compromised due to damage to another customer's clothing or other delays attributable to LEPEG, the company will contact the customer to discuss potential product replacements. If no agreement is reached, LEPEG will refund the amounts withheld.

5.4 – Payment for services is required at the time of booking and will be processed by charging the credit card or other payment method used by the Customer. In cases of failure to return the dress or if it is returned with irreparable damage, the Customer must pay a financial penalty equivalent to the extent of the damage or delay. The Customer authorizes LEPEG to charge the due amount to their credit card and must not obstruct this payment process. If the charge to the Customer's card fails, an alternative payment method must be provided to cover the costs.

5.5 – Financial information, such as card numbers and expiration dates, is transmitted via an encrypted protocol, ensuring that neither LEPEG nor third parties can access this information directly.

5.6Order Cancellation: Orders can be canceled up to two weeks before the scheduled delivery date. For orders canceled later, no refund will be possible. For orders made within 15 days of the delivery date, in case of cancellation, the customer may request a voucher for the amount paid, valid for future rentals. Vouchers are valid for 12 months unless otherwise specified.

5.7 – Orders for accessories cannot be canceled or refunded once delivered.

5.8 – For orders placed at our showroom, refunds can be requested under the conditions specified in section 5.6.

5.9 – The Customer may request custom adjustments to the length of long dresses. These requests must be communicated to LEPEG’s Customer Service via email or WhatsApp up to two days before the shipment is sent. Beyond this deadline, adjustments will be based on the previously provided specifications.

6. Shipping & Transport

6.1 – Transport will be handled by a courier selected by LEPEG and delivered to the address specified by the customer at the time of order. The delivery time slot is at the courier's discretion. If the customer is not available to receive the product during the designated time, the courier will attempt delivery again the following day. If the customer remains unavailable, the courier will leave a notice, and the product must be collected at a specified pickup point.

6.2 – LEPEG covers part of the standard shipping costs. If express delivery is requested by the Customer, they will bear the additional shipping costs.

6.3 – LEPEG is not liable for any delivery delays or mishaps caused by the courier, force majeure, or unforeseeable circumstances such as strikes, floods, or epidemics. In such cases where timely delivery is impacted, LEPEG will compensate the customer with a voucher valid for 12 months.

7. Use of the Product

7.1 – The Customer is responsible for using the product with care to avoid damages as described in Article 12.

7.2 – From the moment of delivery, the Customer assumes full responsibility for the product.

5.2 – LEPEG reserves the right to decline rental or trial orders from individuals who cannot be contacted through the provided contact methods (telephone, email) or orders that do not align with the company's commercial policies, such as orders suspected of fraudulent or illegal activities. 7. Use of the Product

7.1 – The Customer is responsible for using the product with care to avoid damages as described in Article 12.

7.2 – From the moment of delivery, the Customer assumes full responsibility for the product.

8. Return of the Product

8.1 – The Customer is required to return the product at the end of the rental period as agreed upon.

8.2 – At the conclusion of the rental term, the Customer must either arrange for the product to be picked up by contacting Lepeg, or personally return it to the Casale Monferrato showroom at Via Roma 86.

8.3 – If the Customer encounters a size issue with the Product, it must be reported immediately to LEPEG. The item should be returned within 24 hours of receipt. Shipping costs will be deducted from the refund, which will be credited to the original payment method or another payment method provided by the Customer, or a voucher valid for 12 months will be issued. It is crucial that the LEPEG tag remains attached; otherwise, the dress will be considered worn, and the rental price will be charged.

9. Failure to Refund

9.1 – If the Product is returned later than the agreed deadline, the Customer will be charged a daily fee of 25% of the Product's rental fee, for up to 8 days.

9.2 – After this period, the Customer will owe an amount equivalent to double the retail price of the Product as listed on the site, with the previously paid amounts deducted according to Clause 9.1.

10. Early Return

If the Product is returned before the end of the agreed rental term, LEPEG will not issue any refunds.

11. Dress Trial – Advance Dress Try-On Service

12.1 – Customers have the option, by selecting the appropriate action on the Site, to request an advance try-on of selected dresses, subject to availability on the site.

12.2 – Duration: The dress trial lasts for one day.

12.3 – This service is available for a fee of €20, including insurance, plus €7 for shipping (returns are free). If the dress does not meet the customer’s needs, and the LEPEG label remains attached, no rental charges will apply.

13. Damage to the Product

13.1 – Minor damages, which LEPEG covers under the standard guarantee and are deemed repairable, include modest stains, creases, detached sequins, unstitched hems, unstitching, and stuck zippers. This list is exhaustive.

13.2 – For any minor damages, LEPEG will not seek reimbursement from the Customer.

13.3 – The Customer may opt for a Plus Guarantee at the time of order for a fee of €50, which covers up to €300 worth of repairable minor damages.

13.4 – For damage beyond minor wear, the repair costs will be assessed and charged to the Customer.

13.5 – If a repair is deemed unfeasible, or if it substantially diminishes the dress’s value or future usability, the Customer will be responsible for 100% of the retail price of the Product.

13.6 – If a customer repeatedly returns damaged products, LEPEG reserves the right to refuse future rental requests from that customer. Notification of such a decision will be communicated via email.

13.7 – The Plus Guarantee covers minor damages during normal use of the dress up to the specified amount. Damage that affects the integrity or reusability of the dress is not covered under this guarantee and will be handled as specified above.

15. Absence of Right of Withdrawal

The Customer does not have the right to withdraw from the contract as provided by articles 64 et seq. of the Consumer Code, as this contract falls under the exclusions listed in art. 55, paragraph 2, letter a), of the Consumer Code. The services begin with the consumer's agreement before the withdrawal deadline.

16. Sale of Products

16.1 – LEPEG reserves the right to sell new, second-hand, and previously rented clothes, as well as conduct end-of-season sales.

16.2 – Shipping costs for items sold are the responsibility of the customer, unless specified otherwise.

16.3 – Customers interested in purchasing rented products can contact LEPEG via email or phone to discuss availability and terms.

16.5 – Returns of purchased products must be initiated within 7 days of receipt by contacting LEPEG via email with the reason for the return. The product must be unworn and all original tags intact. After quality control, LEPEG will either credit the purchase amount (excluding shipping), exchange the product, or issue a voucher.

17. Promotional Codes and Coupons

LEPEG may issue promotional codes and coupons via email or other means, which can be applied for benefits on the Site. These codes are valid for a single order per customer, unless stated otherwise. Codes applied to multiple orders will only validate the first order; subsequent orders using the same code will be cancelled. These codes are not retroactive and cannot be applied to previously processed orders.

19. Protection and Communication of Personal Data

In accordance with the provisions of Legislative Decree no. 196 of 30.6.2003, the Customer acknowledges having been informed about the data protection practices and consents to LEPEG processing their data, within the limits and according to the criteria set by this decree, for purposes necessary for managing the contract.

20. Competent Court

The contract is governed by Italian law. Any disputes related to the application, execution, interpretation, or violation of the contract will fall under the jurisdiction of the court where the Customer resides or is domiciled if within Italy, or otherwise the Court of Alessandria.
